Barringer exposes the problems with medical malpractice
reform, including the “wildly inconsistent verdicts” in malpractice cases and
the troubling rate of defensive medicine in hospitals. Barringer points
out the need for health courts to revitalize the system by establishing
“precedents by which future cases could be judged.” Another key health court
element – the use of “neutral experts” to assist the court – would prevent the
impartial testimony by experts-for-hire that confuses proceedings in the
current system. Health courts, guided by standards based on severity of
injury, could compensate a larger number of patients and “promote greater
reliability.”
