‘Health Courts’ Touted as Malpractice Claim Option

This article summarizes the basic elements of a health court system proposed in the Medical Liability Procedural Reform Act of 2005.  Health courts would entail having judges with medical expertise issue opinions and a set schedule of benefits for noneconomic awards. According to Common Good founder and chair Philip K. Howard, health courts have the potential to fix the problems with medical justice, a system he describes as “polarizing” to jurors.
