discusses the flaws in the “malpractice minefield.” McKelway
quotes Common Good Chair Philip K. Howard’s description of the
malpractice system’s failures: “While litigation affects doctors,
hospitals and the cost of care, it fails miserably in justly
compensating patients.” Endorsing Common Good’s proposals for
health courts and a national compensation system, he notes that such a
system will bring uniformity and adjustments concerning “noneconomic
factors.” Health courts, he argues, would leave trial lawyers “less
inclined to seek out only those cases that hold the most potential for
emotionally charged jury awards.”
