Child Abuse Reporting RequirementsThere are new requirements regarding reporting suspected child abuse in an educational setting. Those requirements are set out in two basic places: Subdivision (hh) of Section 100.2 of the Regulations of the Commissioner of Education and Article 23-B of the New York State Consolidated Laws. Do not confuse these procedures with the procedures and duties contained in Section 413 of the New York State Social Services Law, often referred to as "mandated reporting." They are not the same. The Social Services Law governs reporting of suspected abuse or neglect of a child by someone in parental relation to the child. The Education Law calls for reporting of allegations of abuse of a child by a school employee or volunteer.
