Common Good Chair Cited on the Effects of Too Much Law

In a letter from the president in the latest Federal Bar Council Quarterly, Robert J. Giuffra, Jr. draws on a recent conversation he had with Common Good Chair Philip K. Howard and addresses the consequences of America being mired in law.  “Our overly complex legal system threatens public respect for law,” he writes.  “And, as Philip Howard explains, legal complexity has made it difficult, if not impossible, for our public officials to solve problems, from health care to education to our massive national debt.  Instead, as Mr. Howard states, they propose ‘more laws to deal with failures that are caused by the accumulation of too much law.’”  Mr. Giuffra goes on to offer suggestions for judges, legislators, and fellow lawyers to stem the growth of law.  You can read the piece in full here.

Common Good Chair Addresses TEDxDU

On May 13th, Philip K. Howard presented at TEDxDU, an independently organized TED event at the University of Denver.  In his address – which you can watch here – he presents three steps needed to restore a culture of responsibility in America, including a spring cleaning of accumulated law. 

Common Good Chair on Restoring Responsibility to America’s Schools

Philip K. Howard argues in the Wall Street Journal that a "steady accretion of law...has smothered personality and individual responsibility in schools," forcing educators to "go through the day responding to rules instead of their common sense."  The solution, he relates, is to "let the humans take charge again.  The guiding principle should be to replace legal dictates with individual responsibility."

President Obama Endorses Health Courts

In a recent letter to Congress, President Obama proposed allocating $50 million to states to pilot medical liability alternatives – including special health courts.  The health courts proposal was developed jointly by Common Good and the Harvard School of Public Health as an alternative to the current ad hoc medical liability system.

Common Good Chair on 'Washington vs. Common Sense'

Philip K. Howard argues in the Wall Street Journal that “common sense is nonexistent” in Washington.  Howard cites examples of how law and bureaucracy have stymied schools, American infrastructure, and health care reform, and makes the case that “America must shift the goal of reform from desired results—universal health care, effective schools—to a new philosophy that allows people to get things done.”
